Governor Abigail Spanberger has officially signed SB749/HB217 into law, enacting a ban on the future sale, manufacture, importation, purchase, and transfer of so-called “assault firearms” and magazines capable of holding
more than 15 rounds. The law takes effect July 1, 2026.
This legislation defines a broad range of semi-automatic rifles, pistols, and shotguns with common features, such as pistol grips, folding stocks, and threaded barrels, as prohibited “assault firearms.” While current owners can keep what they already legally possess (grandfathering), the bill imposes Class 1 misdemeanor penalties, including up to 12 months in jail and fines up to $2,500 for violations. It also restricts those convicted under the law from possessing firearms for three years.
Governor’s Statement vs. Reality
In her signing statement, Governor Spanberger claimed, “firearms designed to inflict maximum casualties do not belong on our streets.” This rhetoric ignores that the vast majority of these firearms, including popular AR-15 and AK-style rifles, are commonly used for lawful self-defense, sporting purposes, and hunting. Criminals, by definition, do not follow gun control laws, and Virginia’s existing prohibitions on illegal possession and use already provide tools for prosecution.
The bill passed without the Governor’s proposed amendments that would have offered clearer exemptions for certain hunting shotguns. Gun rights organizations and the Department of Justice have already filed or announced legal challenges, arguing the ban infringes on Second Amendment rights protected by recent Supreme Court precedents.
